Dear Mr. Singh,
Thank you for your three emails of today at 12:14 pm, 12:17 pm and 1218 pm. and I submit as follows:
1. Ref. your 1st email of 12:44 pm of 15/12/09 I shall request you to kindly read my email of 05/12/09 in the trailing mail, wherein I quoted all your sms received by me including the one of 24/11/09 and I quote it again:
"From: TM-12525 Enjoy LOWEST Tariff for LIFETIME on Rs. 101 Top Up. T2T-10p/Others-25p/STD-75p from (9pm-9am) & T2T-20p/Others-50p/STD-1.5 from (9am-(pm). Daily Rental-Re 1. 08:11am 24/11/09." It does not contain any extra word. Nowhere it mentioned "next 5 days" as you have stated.Thus this statement of yours being factually incorrectis unfair and is not acceptable.
I am ready to show all your sms to any authority for verification.
2. Your sms dated 29/11/09: " From: TataIndicom Dear Customer, 2. Your sms dated 29/11/09: " From: TataIndicom Dear Customer, Recharge of Rs.101.0 is successful, Current balance is Rs. 90.30, TransID:497512210. To register in NDNC, SMS 'start DND' to 1909. Thank You-Tata Indicom 11:46 am 29/11/09." is successful, Current balance is Rs. 90.30, TransID:497512210. To register in NDNC, SMS 'start DND' to 1909. Thank You-Tata Indicom 11:46 am 29/11/09."
This proves that TataIndicom has accepted my Recharge of Rs.101.0 as successful, with their Trans ID:497512210.
Thus you cannot negate the benefits of Rs. 101 Rechararge plan to me and you must restore my lawful rights w.e.f. 11:46 am of 29/11/09, without further delay.
3. Your 2nd email of 12:17 pm of 15/12/09 stating
"Nodalofficer Kolkata would like to recall the message, "Re: Pre-paid connection:9231655485: Complain No. PCR06088014 dated 05/12/09".
although sent to me, it is not formally addressed to me. Please let me know why it has been sent to me and what am I to understand from it. If you intend to mean that you have rejected my complain, I am to say NO, you cannot do so lawfully.
4. Your 3rd email of 12:18 of 15/12/09 being almost identical to the one 1st one of appears to be unnecessary repetition with the same false story of "next 5 days".

Dear Sir/Madam,
Today I received an SMS in my above mobile which reads as follows:
"Dear Customer, we have registered your complaint under service request PCR06088014. We shall get back to you with the resolution within 60 hours".
I thank you and congratulate your management for such admirable customer-friendly sms communication which assures the customer that there exists some dependable and on record methodology for customer-care herein and thereby enhances confidence of customer in Tata-Indicom.
While thanking you as above, I would like to keep you informed about the background of the above complaint sequentially:
1. Your sms dated 24/11/09: "From: TM-12525 Enjoy LOWEST Tariff for LIFETIME on Rs. 101 Top Up. T2T-10p/Others-25p/STD-75p from (9pm-9am) & T2T-20p/Others-50p/STD-1.5 from (9am-(pm). Daily Rental-Re 1. 08:11am 24/11/09."
2. Your sms dated 29/11/09: " From: TataIndicom Dear Customer, Recharge of Rs.101.0 is successful, Current balance is Rs. 90.30, TransID:497512210. To register in NDNC, SMS 'start DND' to 1909. Thank You-Tata Indicom 11:46 am 29/11/09."
3. Naturally, I believed this Tariff has been effected from 11:46 on 29/11/09 and I continued to use my mobile accordingly.
4. On 03/12/09, I noticed that you are deducting call charges for minor duration T2T calls @ Re. 1/- per call.
5. At 08:56 am03/12/09, I called your Helpline No. 12525 and I was informed that "1. Recharge to a new Tariff plan is effected only after 5 days of such Recharge. 2. My Recharge will be effected from 12:00 hrs. at midnight ending 04/12/09. 3. He specifically confirmed me on checking the records."
6. This morning at 06:01 am on 05/12/09, I checked my Balance from your Helpline No. 12527 to be Rs.70.30.
7. At 08:25 am on 05/12/09, I made a call to a T2T connection for 1 min. 04 sec.
8. At 08:51 am on 05/12/09, I rechecked my Balance with 12527 and to my surprise found Re. 1/- has been deducted.
9. Immediately at 08:51 am I contacted your 12525 and the Lady Official very kindly expressed her regret and assured me that it will be effected from 8:55 pm on 10/12/09.
On my insistence, she recorded the complaint No. 06088014. On my enquiry whether this will be effected with retrospective effect, she referred me to her Senior Supervisor (Sri Kaushik Ghosh), who summarily informed me that I am not entitled for this Tariff Plan. He was not ready to accept that TataIndicom had informed me by sms that my "Recharge of Rs.101.0 is successful".
In view of the above sequence of events ( all being on record at your end, including the discussions that I had with your Helpline Officials), my humble submissions are as follows:
1. Tata Indicom has invited/dragged me to this plan by their SMS and I an not an illegal intruder.
2. Tata Indicom has accepted my money (Rs. 101.00) for this plan which they could have refused if I am not entitled for this Plan.
3. Tata Indicom never informed me that it will take 5 days or 5+5=10 days to activate this scheme as communicated by your Helpline Officials.
4. Tata Indicom Helpline Senior Supervisor's statements very unkindly indicts me to be an illegal intruder into this Plan-101, is simply insulting and unacceptable.
5. If I am ineligible to this Tariff Plan, Tata Indicom ought not have invited me to join it, could deny Recharging, ought not sms me of "successful recharge" therein.
6. Tata Indicom's deductions from my balance @ Re. 1/per call even after my "successful recharge" to Tariff Plan Rs. 101/-, is unfair, if not illegal and they cannot do so without formally informing me and without obtaining my formal consent.
I now lawfully demand that my account be re-adjusted, without further delay, according to Tariff Plan Rs.101 as was intimated to me in your sms dated 24/11/09 mentioned above, with retrospective effect from 11:46 am 29/11/09 when I was successfully recharged to this Tariff Plan of Rs. 101/-.
Please let me record that all your officials with whom I interacted were very polite but from their contradicting versions on the same issue, it appeared to me that that they are not well informed. Very frequent introduction of many new plans of Tariff without proper grooming of the staff may be a reason but I am not the authority to judge.
